1. Introduction

Welcome to Visarun. These Terms of Service (“Terms”) govern your access to and use of the Visarun platform, website, and related services (collectively, the “Service”) operated by Visarun LLC-FZ, a company incorporated in a UAE Free Zone (“Visarun”, “we”, “us”, or “our”).

By accessing or using the Service, creating an account, or completing a payment, you (“User”, “you”) confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use the Service.

2. Description of Service

Visarun is an online visa facilitation platform. We provide technology-assisted services to help users prepare, submit, and track visa applications for various countries. Our services include:

  • Document collection and verification assistance
  • Automated visa application form preparation
  • Application submission on behalf of the user
  • Application status tracking and notifications
  • Customer support throughout the visa process

IMPORTANT — VISA OUTCOME DISCLAIMER:

Visarun is NOT a consulate, embassy, or government authority. We do not issue visas and have no influence over visa approval decisions. Visa issuance decisions are made solely by the relevant embassy, consulate, or immigration authority of the destination country. Visarun does not guarantee that a visa application will be approved. Approval, rejection, or additional requirements are entirely at the discretion of the issuing authority.

No Legal Advice.

Visarun does not provide legal advice, immigration advice, or legal representation. The Service is a technology-assisted facilitation platform and is not a substitute for consultation with a qualified immigration lawyer or licensed legal representative. Nothing communicated by Visarun, its employees, agents, or automated systems shall be construed as legal advice. Users requiring legal advice regarding their specific immigration matter should consult a qualified legal professional authorized to practice in the relevant jurisdiction.

3. Fees and Pricing

All fees are displayed transparently before you complete your purchase. Your total payment consists of two separate components:

a) Service Fee: The fee charged by Visarun for providing the facilitation service, including document review, application preparation, and submission support. This fee is payable to Visarun.

b) Visa / Consular Fee: The official fee required by the embassy, consulate, or immigration authority of the destination country. This fee is paid on your behalf to the relevant government authority. The amount is set by the authority and may change without notice.

Both components are displayed separately and itemized on the checkout page prior to payment confirmation. You will not be charged any amount beyond what is shown at checkout.

4. Refund Policy

Refunds are subject to our Refund Policy, which is incorporated into these Terms by reference and available at:

www.visarun.ai/b2c/refund-policy

Key principles:

  • The Visa / Consular Fee is paid directly to the relevant government authority on your behalf and is generally non-refundable once submitted, regardless of the outcome of your application.
  • The Visarun Service Fee may be refunded in certain circumstances as detailed in the Refund Policy.
  • Refund eligibility depends on the stage of processing at the time the refund request is submitted.

5. User Obligations

By using the Service, you agree to:

  • Provide accurate, complete, and truthful information in all documents and forms submitted through the Service.
  • Ensure that all documents uploaded are genuine, unaltered, and valid.
  • Promptly respond to any requests for additional information or clarification.
  • Comply with all applicable laws and regulations of your country of residence and the destination country.
  • Not use the Service for any fraudulent, unlawful, or deceptive purpose.
  • Not attempt to submit applications for third parties without proper legal authorization.
  • Be solely responsible for ensuring your own eligibility for the visa or entry requirements of the destination country, including assessment of factors such as nationality, criminal record, prior immigration history, health requirements, and financial sufficiency.

You acknowledge that the accuracy and completeness of submitted information directly affects the outcome of your visa application. Visarun is not liable for rejections resulting from incomplete, inaccurate, or fraudulent information provided by the user.

Eligibility Responsibility. The user is solely responsible for ensuring that they meet the eligibility criteria and visa requirements of the destination country prior to submitting an application through the Service. This includes, without limitation, verifying passport validity, nationality-specific requirements, prior immigration or travel history, the existence of any outstanding bans or refusals, and the sufficiency of supporting documentation. Visarun does not make any binding determination of eligibility and does not guarantee that a user meets visa requirements. Submission of an application through the Service does not constitute an endorsement by Visarun of the user's eligibility, and no refund shall be due where an application is refused on grounds of ineligibility that existed at the time of submission.

5.1 Fraudulent or False Information

Visarun expressly disclaims all liability and responsibility — and no refund of any fee, whether the Visarun Service Fee or the Visa / Consular Fee, shall be due or payable — in any case where the user has provided, uploaded, or submitted false, forged, altered, or otherwise fraudulent documents or information in connection with a visa application processed through the Service.

This includes, without limitation: falsified identity documents, altered financial statements, fabricated employment letters, misrepresented travel history, or any other document or declaration that does not accurately reflect the applicant's true circumstances. In such cases, Visarun also reserves the right to immediately suspend or terminate the user's account and to report the matter to the relevant authorities where required by law.

5.2 Failure to Submit Documents or Information on Time

Visa applications are subject to strict deadlines set by the relevant embassy, consulate, or immigration authority. Visarun shall bear no liability, and no refund of any fee shall be due, in any case where a visa application is delayed, rejected, or rendered impossible to submit as a result of the user's failure to provide required documents or information within the timeframes communicated by Visarun during the application process.

The user is solely responsible for responding to requests for additional documents or information promptly. Deadlines communicated via email, SMS, or through the Visarun platform constitute formal notice. Late submission that results in a missed consular appointment, expired invitation letter, or lapsed application window shall not entitle the user to any refund or compensation from Visarun.

6. Account Registration

To use certain features of the Service, you may be required to create an account. You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activity that occurs under your account.
  • Notifying us immediately at support@visarun.ai if you suspect unauthorized access to your account.

You must be at least 18 years of age to create an account and use the Service. By registering, you confirm that you meet this requirement.

Authorization for Third-Party Submissions. Users who submit a visa application, upload documents, or otherwise use the Service on behalf of another person (including family members, dependents, employees, or clients) represent and warrant that they have obtained all necessary authorizations, consents, and legal authority from such person to do so, including consent to the collection and processing of that person's personal data. For minors, the submitting user must be a parent or legal guardian, or hold documented authorization from a parent or legal guardian. Visarun may require evidence of such authorization at any time and reserves the right to refuse or suspend service where authorization cannot be verified. The submitting user shall indemnify Visarun against any claim arising from the absence of valid authorization.

7. Intellectual Property

All content, software, technology, and materials on the Visarun platform — including but not limited to text, graphics, logos, icons, images, and code — are the exclusive property of Visarun LLC-FZ or its licensors and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

8. Privacy and Data Protection

Your privacy is important to us. Our collection and processing of personal data is governed by our Privacy Policy, available at:

www.visarun.ai/b2c/privacy-visa-users

By using the Service, you consent to the collection, storage, and processing of your personal data as described in the Privacy Policy.

Data Deletion. Users may request deletion of their personal data held by Visarun at any time, subject to the terms and procedures set out in our Privacy Policy. Requests may be submitted by contacting support@visarun.ai. Visarun will process deletion requests in accordance with applicable data protection laws. Please note that certain data may be retained where necessary to comply with legal, regulatory, or tax obligations, to resolve disputes, or to enforce these Terms, as further described in the Privacy Policy. Deletion of account data may render it impossible to continue providing the Service.

For users in India: In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (IT Rules 2021), we have appointed a Grievance Officer to address complaints from Indian users. See Section 12 below.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Visarun and its directors, employees, partners, and agents shall not be liable for:

  • Visa refusals, delays, or additional requirements imposed by any embassy, consulate, or immigration authority.
  • Any loss, damage, or expense arising from reliance on information provided through the Service.
  • Indirect, incidental, special, consequential, or punitive damages of any kind.
  • Losses arising from circumstances beyond our reasonable control, including but not limited to changes in immigration policy, political events, natural disasters, or pandemics.

Visarun's total liability to you for any claim arising out of or in connection with these Terms or the Service shall not exceed the total amount of fees paid by you to Visarun for the specific service giving rise to the claim.

9.1 Sovereign Authority of Consular Bodies

The decision to grant, refuse, or impose conditions upon a visa application rests exclusively with the competent embassy, consulate, high commission, or immigration authority of the relevant destination country (“Consular Authority”). Such decisions constitute the sovereign exercise of governmental authority and are entirely outside the control, influence, or responsibility of Visarun.

Visarun expressly disclaims, to the fullest extent permitted by applicable law, any and all liability arising from or in connection with: (i) the refusal of a visa application by any Consular Authority, regardless of the grounds for such refusal; (ii) the processing time, issuance timeline, or any delay in the determination of a visa application by any Consular Authority; and (iii) any requirement imposed by a Consular Authority for the submission of additional documents, information, interviews, biometrics, or other conditions not reasonably foreseeable at the time of application.

Any processing timelines or estimated issuance dates communicated by Visarun are indicative only, based on publicly available information, and do not constitute a guarantee, representation, or warranty as to the actual processing time of any Consular Authority. Consular processing times are subject to change without notice and may be affected by factors including, without limitation, seasonal demand, administrative capacity, public holidays, political developments, or changes in government policy.

9.2 Exclusion of Consequential and Travel-Related Losses

Under no circumstances shall Visarun be liable to the user or any third party for any indirect, incidental, special, consequential, punitive, or exemplary loss or damage of any nature whatsoever arising out of or in connection with a visa refusal, delay in visa issuance, or any request for additional documentation by a Consular Authority.

Without limiting the generality of the foregoing, Visarun shall bear no liability whatsoever in respect of: (i) the cost of any airline tickets, flights, or other transportation purchased or booked in anticipation of travel; (ii) hotel, accommodation, or lodging reservations; (iii) tour packages, excursions, or travel itineraries; (iv) travel insurance premiums; (v) currency exchange losses; (vi) loss of earnings, business opportunities, or contractual obligations; or (vii) any other financial loss, expense, or damage, whether direct or indirect, arising from the user's reliance on an anticipated visa outcome or travel date.

Users are strongly advised not to purchase non-refundable travel arrangements prior to receiving confirmation of a visa grant from the relevant Consular Authority. Visarun assumes no responsibility for losses arising from the user's election to do so.

10. Disclaimers

The Service is provided on an “as is” and “as available” basis. We do not warrant that:

  • The Service will be uninterrupted, error-free, or free of viruses or other harmful components.
  • Any information provided through the Service is accurate, complete, or up to date.
  • The Service will meet your specific requirements.

All visa requirements, processing times, and consular fees displayed on our platform are provided for informational purposes only and are subject to change by the relevant authorities. Users are advised to verify requirements with the official embassy or consulate of the destination country.

Third-Party Dependencies. The Service relies on third-party systems and providers, including but not limited to government portals, embassy and consulate websites, e-visa platforms, biometric appointment systems, payment processors, courier services, identity verification providers, cloud hosting, email and SMS delivery, and other external infrastructure. Visarun does not control such third-party systems and shall not be liable for any interruption, outage, malfunction, error, delay, data loss, or failure caused by or arising from any third-party system, including scheduled maintenance, technical failures, policy changes, service suspensions, or the discontinuation of any third-party service. Where a third-party system is unavailable, Visarun will make reasonable efforts to resume operations but assumes no liability for delays or failures in visa processing attributable to such third-party systems. Visarun does not guarantee specific response times, processing times, or support turnaround times unless explicitly stated.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates.

In the event of any dispute arising out of or in connection with these Terms or the Service, the parties agree to first attempt resolution through good-faith negotiation. If a resolution cannot be reached within 30 days, the dispute shall be submitted to arbitration in accordance with applicable UAE arbitration rules.

For users in India: Nothing in this clause limits your rights under applicable Indian consumer protection laws.

Language. These Terms may be made available in languages other than English for the user's convenience. In the event of any conflict, discrepancy, or inconsistency between the English version and any translation, the English-language version shall prevail and shall be the sole authoritative version for purposes of interpretation, enforcement, and dispute resolution.

12. Grievance Officer — India

In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, Visarun has designated a Grievance Officer for India. Users in India may contact the Grievance Officer to report any concerns, complaints, or violations relating to content or the Service:

Name: Bibin Babu

Email: grievance@visarun.ai

Response Time: Within 30 days of receipt of complaint

Complaints must be submitted in writing and include sufficient detail to allow investigation. We will acknowledge receipt of your complaint within 48 hours.

13. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will:

  • Update the “Last Updated” date at the top of this document.
  • Notify registered users via email or in-app notification at least 14 days before changes take effect.
  • Where required by law, obtain fresh consent from users.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.

14. Termination

We reserve the right to suspend or terminate your access to the Service, without prior notice, if you:

  • Violate any provision of these Terms.
  • Provide false, fraudulent, or misleading information.
  • Engage in any conduct that is harmful, abusive, or illegal.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including limitation of liability, disclaimers, and dispute resolution) shall continue to apply.

15. Binding Agreement

By accessing or using the Service, creating an account, or completing a payment, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. These Terms constitute a binding legal agreement between you and Visarun LLC-FZ. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

If you do not have the authority to agree to these Terms, or if you do not agree to all of the Terms, you must not access or use the Service.

16. Force Majeure

Visarun shall not be liable for any failure or delay in performance of its obligations under these Terms arising from causes beyond its reasonable control, including but not limited to: acts of God, war, terrorism, pandemic, embassy or consulate closures, suspension of visa processing by any government authority, strikes, civil unrest, internet or telecommunications failures, or any change in applicable law or government regulation.

In such circumstances, Visarun will notify users as soon as reasonably practicable and will make reasonable efforts to resume performance. Force majeure events do not affect your obligation to pay fees for services already rendered.

17. General Provisions

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Visarun LLC-FZ with respect to the Service and supersede all prior agreements, understandings, representations, and warranties, whether written or oral, relating to the subject matter hereof. No oral or written representation made by any Visarun employee or agent outside of these documents shall be binding on Visarun.

Waiver

No failure or delay by Visarun in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy. No single or partial exercise of any right shall preclude any other or further exercise of that right or the exercise of any other right.
